These Terms govern your access to and use of the Brime APIs and related services. They are written in plain English so you can read them without a lawyer — but they are still a binding agreement. By using the Service, you agree to these Terms and our Privacy Policy.
1. Acceptance of terms
By creating a Brime account, accessing the Service, or making API calls against any Brime endpoint, you (the “Customer”) enter into a binding agreement with Brime, Inc. If you accept these Terms on behalf of an organization, you represent that you are authorized to bind that organization. You must be at least 18 years old to use the Service.
2. The Service
Brime provides web data APIs for AI applications — search, extract, research, and related developer tools, together with a console at brime.dev (the “Service”). The Service is offered on a subscription basis according to the plan you select.
We may modify the Service, including adding or removing features, changing rate limits, or adjusting how endpoints behave. We will give reasonable notice for material changes that adversely affect your existing integration.
3. Account
You must provide accurate registration information and keep your credentials and API keys secure. You are responsible for all activity under your account, including team members you invite and any automated agents authenticated with your keys.
Notify us immediately at support@brime.dev if you suspect a key has been compromised.
4. Acceptable use
You agree not to use the Service to:
- scrape, mirror, or proxy the Service in a way designed to circumvent quotas, rate limits, or billing;
- attempt to reverse-engineer, decompile, or derive source code from the Service;
- submit content you do not have the right to process, or content that infringes any third party's intellectual property, privacy, or other rights;
- target individuals for surveillance, harassment, doxing, or any activity prohibited by law;
- build a product whose primary purpose is to compete with the Service using outputs derived from it;
- disrupt the integrity, security, or availability of the Service or any other Brime customer's use of it.
We may suspend or terminate accounts that violate this section.
5. Fees and billing
Paid plans are billed monthly or annually in advance in US dollars via our payment processor. Quotas reset at the start of each billing period. Usage above plan limits is billed at the rate published on the Pricing page.
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. Pricing may change with at least 30 days' notice; changes apply from the next billing cycle.
Failed payments may result in suspension after 14 days of notice. You are responsible for any taxes, duties, or levies imposed on your purchase, except for taxes on our income.
6. Refund and cancellation
All fees paid are non-refundable. Unused API credits and quota do not carry over between billing periods and are not eligible for refund. You may cancel your subscription at any time from the Console; cancellation takes effect at the end of the current billing period and you retain access until that date.
If you believe you were charged in error or you experienced a significant service outage attributable to Brime, contact support@brime.dev within 30 days of the charge. We will review the issue in good faith and, where warranted, issue a service credit or refund at our discretion.
7. AI outputs
Some Brime endpoints (including but not limited to /search answers and /research syntheses) use AI models that summarize, generate, or transform web content. AI outputs may be inaccurate, incomplete, outdated, biased, or unsuitable for your purpose.
You are solely responsible for verifying outputs before relying on them, especially in safety-critical, medical, legal, financial, or regulatory contexts. AI outputs do not constitute professional advice. You must not represent AI outputs as human-generated where that would mislead recipients.
8. Intellectual property
Brime owns the Service, the APIs, and all related software, documentation, and brand assets. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service during your subscription term, subject to these Terms.
You retain all rights in the inputs you submit and the outputs returned to you. You grant Brime a limited license to process your inputs solely to provide the Service, secure it against abuse, comply with law, and produce aggregated, non-identifying analytics.
We do not train models on your customer content. Feedback you send us (suggestions, bug reports) may be used freely to improve the Service.
9. Third-party services
The Service relies on third-party providers (model vendors, infrastructure providers, payment processors). Their performance is outside our control, and your use of any third-party service accessed through Brime is subject to that provider's own terms. We are not responsible for losses caused by third-party services beyond our reasonable control.
10. Privacy
Our Privacy Policy describes how we collect, use, and protect personal information. It is part of these Terms.
You must not submit special-category data (such as health, biometric, government ID, or payment-card data) through customer inputs unless you have an executed Data Processing Agreement with us that explicitly permits it.
11. Warranty disclaimer
The Service is provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in a signed subscription agreement. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements.
12. Limitation of liability
To the maximum extent permitted by law, Brime's aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid Brime in the 12 months preceding the event giving rise to the claim.
Neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages.
13. Indemnification
You will indemnify and hold Brime, its officers, employees, and contractors harmless from any third-party claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your inputs or how you use the outputs, (b) your breach of these Terms or our Acceptable Use Policy, or (c) your violation of any law or third-party right.
14. Termination
You may terminate your account at any time from the Console. Brime may terminate or suspend access for material breach, for non-payment, or immediately for fraud, security, or legal reasons. Upon termination, your right to use the Service ends and we delete your data within 30 days unless required by law to retain it.
Sections that by their nature should survive termination — including payment obligations, IP, disclaimers, liability limits, indemnification, and governing law — will survive.
15. Force majeure
Neither party is liable for failure or delay in performance (other than payment obligations) caused by events beyond reasonable control, including natural disasters, governmental actions, internet or cloud-provider outages, cyber-attacks, or labor disputes.
16. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms will be brought in the state or federal courts located in Delaware, and the parties consent to that jurisdiction, except that either party may seek injunctive relief in any competent court.
17. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced at least 30 days in advance via email or in the Console. The “Last updated” date above reflects the most recent revision. Continued use of the Service after the effective date constitutes acceptance.
